1. Agreement to these Terms

These Terms of Use (“Terms”) are an agreement between you and SideAction Sports LLC (“SideAction,” “we,” “us,” or “our”). They apply to SideAction Sports Picks, SideAction Pulse, sideaction.app, and related applications, websites, content, features, and communications (collectively, the “Services”).

By creating an account or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility and accounts

You must be at least 13 years old to use the Services. If you have not reached the age of majority where you live, you may use the Services only with permission from a parent or legal guardian. You may not use the Services where doing so is prohibited by law.

You agree to provide accurate account information, keep access to your email account secure, and promptly notify us if you believe your SideAction account has been compromised. You are responsible for activity performed through your account. Do not share verification codes or session credentials.

Handles and league names must not impersonate another person, infringe rights, or contain unlawful, threatening, hateful, sexually explicit, or abusive content.

4. Acceptable use

You may not:

• use the Services for unlawful activity or real-money gambling;
• harass, threaten, deceive, or impersonate another person;
• manipulate competitions, exploit defects, collude, or automate gameplay;
• access another person’s account or attempt to bypass security controls;
• scrape, reverse engineer, disrupt, overload, or damage the Services;
• upload malicious code or interfere with other users; or
• use SideAction names, marks, data, or content in a way that infringes rights.

We may investigate suspected violations and take reasonable steps to protect users, competition integrity, and the Services.

5. Content and licenses

The Services, including their software, branding, designs, text, graphics, and compilation of data, are owned by SideAction or its licensors and protected by applicable intellectual-property laws. Subject to these Terms, we grant you a limited, personal, nonexclusive, nontransferable, revocable license to use the Services for their intended purpose.

You retain ownership of content you submit, such as handles, league names, and support messages. You grant us a worldwide, nonexclusive, royalty-free license to host, process, reproduce, and display that content only as reasonably necessary to operate, secure, and improve the Services.

Team names, league names, statistics, and other third-party materials belong to their respective owners. SideAction is not sponsored by or affiliated with any professional or collegiate sports league or team unless expressly stated.

6. Sports data, media, AI, and Service availability

Sports schedules, results, statistics, projections, and simulated market information may be delayed, incomplete, corrected, or unavailable. We may correct scoring, settlement, rankings, and virtual balances when underlying data changes or an error is identified.

News, commentary, summaries, recommendations, personalization, and AI-assisted features may be incomplete, delayed, unavailable, or occasionally inaccurate. They are provided for general sports information and entertainment, not as a substitute for an official source or professional advice.

We may add, modify, suspend, or discontinue features and may perform maintenance without notice. We do not guarantee that every sport, league, game, market, or competition will always be available.

7. Privacy

Our Privacy Policy explains how we collect, use, share, retain, and protect information. By using the Services, you acknowledge those practices across the Services.

8. Disclaimers and limitation of liability

To the maximum extent permitted by law, the Services are provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, and noninfringement. We do not warrant uninterrupted, error-free, or completely secure operation or the accuracy of sports data, media, personalization, or AI-assisted output.

To the maximum extent permitted by law, SideAction and its service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, goodwill, or opportunity, arising from the Services. Nothing in these Terms excludes liability that cannot lawfully be excluded.

9. Suspension and termination

You may stop using the Services at any time. Where in-app deletion is available, including in SideAction Sports Picks, you may permanently delete your account from Account Controls on the Profile page. If you cannot access your account, visit our Support page for assistance. We may restrict, suspend, or terminate access when reasonably necessary to address a Terms violation, protect users or competition integrity, respond to legal requirements, or secure the Services.

Provisions that by their nature should survive termination—including ownership, disclaimers, limitations of liability, and dispute-related provisions—will continue to apply.

10. Changes to these Terms

We may update these Terms as the Services or applicable requirements change. We will post updated Terms here and revise the effective date. If changes are material, we may also provide notice through the Services or by email. Continued use after the updated Terms take effect means you accept them.
